A Landmark Ruling Against a Former President
Brazil faces a completely new situation. The highest court in the country made a major decision on September 11, 2025. They determined that former president Jair Bolsonaro worked to undo the outcome of the 2022 election, attempting to stay in office by illegal means. The judges largely agreed that Bolsonaro worked with others to try to overthrow Brazil’s government, a situation that might result in a very long prison sentence for him.
This decision means Bolsonaro is the first former Brazilian president found guilty of trying to overthrow the government, a huge change for someone who used to have a lot of power in politics. Three of the five judges on the court decided to find the person guilty. Judges Cármen Lúcia, Alexandre de Moraes, Flávio Dino stated evidence revealed Bolsonaro actively worked to gather supporters, prepared emergency orders, fueled the disturbances leading to the January 8, 2023 assault on government structures in Brasília.
Justice Luiz Fux disagreed, stating evidence did not clearly connect Bolsonaro to every part of the plan. He also wondered if the court had the authority to handle some of the accusations. Cristiano Zanin, a justice, hadn’t given his vote yet, but enough justices had voted to show the result: Bolsonaro tried to overthrow the government. The Charges and the Evidence

The court decided the riots weren’t just quick bursts of anger, they were a planned event. Investigators found documents, meeting recordings showing Bolsonaro with supporters planning to change the election results. They also discovered proposed official orders that might have let him use special powers during a crisis. Statements from government officials, alongside documents found during the investigation, showed Bolsonaro really pushed for, helped with, a plan to stop Luiz Inácio Lula da Silva from becoming president after a fair election.
Investigators showed how Bolsonaro’s statements, his actions following the 2022 election, fueled increasing violence. He often shared untrue stories about the election, told people not to trust voting machines, ignited frustration among the public. After people broke into government buildings, detectives said his actions naturally caused this.
Justice Fux questioned if enough evidence connected Bolsonaro to people who used violence, but most of the court dismissed those concerns. Judge Alexandre de Moraes, a key figure in probes of actions against democracy, stated letting Bolsonaro’s behavior pass without consequence poses a continuing threat to democratic governance.

Bolsonaro’s guilty verdict changes Brazil’s political landscape now, it will continue to do so going forward.
